SunshineSlingshot Desktop Application

This End User License Agreement ("EULA") is a legal agreement between you ("User") and SunshineSlingshot ("Licensor", "we", "us") for the SunshineSlingshot desktop application for Windows and macOS ("the Application"). By installing, copying, or otherwise using the Application, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the Application.
The Application is a desktop client that connects to the SunshineSlingshot cloud service. Your use of the Service itself — including account management, content scheduling, publishing, analytics, billing, and all data processing — is governed by our Terms of Service and Privacy Policy, which are incorporated into this EULA by reference. This EULA covers only the additional terms specific to the installed desktop application. In the event of a conflict between this EULA and the Terms of Service, the Terms of Service shall prevail regarding service-related matters, and this EULA shall prevail regarding application-specific matters.
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on devices you own or control, solely for the purpose of accessing the SunshineSlingshot service. This license is conditional on your compliance with this EULA and an active SunshineSlingshot account (either during a free trial or with a paid subscription).
You may not: modify, reverse engineer, decompile, or disassemble the Application; distribute, sublicense, lease, rent, or lend the Application to third parties; remove or alter any proprietary notices, labels, or marks in the Application; use the Application to develop a competing product or service; use the Application in any way that violates applicable law or our Terms of Service.
The Application is a native desktop wrapper (built with Tauri) that provides access to the SunshineSlingshot web service with additional desktop-native capabilities. The Application:
Connects to the internet: The Application requires an active internet connection to function. It communicates with SunshineSlingshot servers to load the dashboard, publish content, sync data, and perform all service operations. The Application does not function offline except for locally cached interface elements.
Accesses the local filesystem: With your permission, the Application can access files in your Pictures, Videos, Desktop, Downloads, and Documents folders for the purpose of selecting media to upload to the Service. The Application uses your operating system's native file picker dialog. It does not scan, index, or read files beyond what you explicitly select. No local files are accessed without user-initiated action.
Uses system notifications: The Application may display native desktop notifications for alerts, scheduled post reminders, and other service events. You can disable notifications through your operating system's notification settings.
Accesses the clipboard: The Application can read from and write to the system clipboard for copy/paste operations within the dashboard.
The Application does not store personal data locally beyond standard browser cache and session data. All user content, account data, and analytics are stored on SunshineSlingshot servers as described in our Privacy Policy. Media files you select from your local filesystem are uploaded to SunshineSlingshot servers for publishing — the Application does not retain copies beyond the upload process. Local cache data may be cleared by uninstalling the Application or clearing the Application's data through your operating system.
We may release updates to the Application from time to time to fix bugs, improve performance, or add features. Updates may be delivered automatically or may require manual download and installation. Continued use of the Application after an update constitutes acceptance of any changes. We recommend always using the latest version. We are not obligated to provide updates or to maintain backward compatibility with older versions indefinitely.
The Application requires: Windows 10 or later (64-bit) for the Windows version; macOS 10.15 (Catalina) or later for the macOS version. The Application requires an active internet connection and a modern display with a minimum resolution of 900×600 pixels. We do not guarantee compatibility with all hardware configurations, virtualization environments, or modified operating systems.
The Application, including its code, design, graphics, and documentation, is owned by SunshineSlingshot and is protected by copyright and other intellectual property laws. This EULA does not grant you any ownership rights in the Application. The SunshineSlingshot name, logo, and branding are trademarks of SunshineSlingshot.
The Application is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Application will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by law, SunshineSlingshot shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Application. This includes, without limitation, damages for loss of data, business interruption, or any other commercial damages or losses. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application and uninstall it from all devices. Termination of your SunshineSlingshot account (whether by you or by us) also terminates this EULA. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.
The Application is built using Tauri, an open source framework licensed under the MIT License. The Application may include other open source components, each governed by their respective licenses. A list of open source components and their licenses is available in the Application's installation directory. The use of open source components does not affect the proprietary nature of the SunshineSlingshot application and service code.
This EULA is governed by the laws of the United States. Any disputes arising under this EULA shall be resolved in the courts of the state in which the Licensor is headquartered.
