By accessing or using SunshineSlingshot ("the Service"), operated by SunshineSlingshot ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
SunshineSlingshot is a cloud-based social media scheduling and management platform. We provide tools for scheduling posts, managing social media accounts, monitoring brand mentions, generating AI-assisted content, tracking analytics, and team collaboration. The Service is provided "as is" and "as available."
You must provide accurate, complete registration information. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old or the age of majority in your jurisdiction. One person or legal entity may not maintain more than one account. You are responsible for all activity that occurs under your account.
SunshineSlingshot is offered at $75 per month (billed monthly) or $50 per month (billed annually at $600 per year). Payments are processed by Square, Inc. All fees are non-refundable except as required by law. We may change pricing with 30 days advance notice. Failure to pay may result in suspension or termination of your account after a 7-day grace period. You may cancel your subscription at any time; access continues until the end of the current billing period. After cancellation, your data is retained for 30 days before permanent deletion.
New accounts receive a 14-day free trial with full access to all features. At the end of the trial, you must subscribe to continue using the Service. No credit card is required for the trial. We will not charge you without your explicit consent. If you do not subscribe, your account will be locked but your data will be retained for 30 days, during which you can subscribe to restore full access.
We may offer promotional discount codes from time to time. Promo codes are subject to specific terms communicated at the time of issuance, including discount amount, duration, and expiration date. Codes are non-transferable, cannot be combined with other offers, and have no cash value. We reserve the right to modify or cancel promotional codes at any time. When a time-limited discount expires, your subscription automatically reverts to the standard price. You will be notified before any price change takes effect. Abuse of promotional codes, including creating multiple accounts to use the same code, may result in account termination.
You agree not to: violate any applicable law or regulation; infringe on any third party's intellectual property; upload malicious code, viruses, or harmful content; attempt to gain unauthorized access to the Service; use the Service to send spam or bulk unsolicited messages; resell or redistribute the Service without authorization; use automated scraping or data mining tools against the Service; impersonate another person or entity.
You retain ownership of all content you create, upload, or publish through the Service ("Your Content"). By using the Service, you grant us a limited license to process, store, and transmit Your Content solely for the purpose of providing the Service. We do not claim ownership of Your Content. We own all rights to the Service, including its design, code, features, and documentation.
The Service integrates with third-party platforms (Twitter/X, Instagram, Facebook, LinkedIn, TikTok, Pinterest, YouTube, Threads, Bluesky, Mastodon) and AI providers. Your use of these integrations is subject to the respective platform's terms of service. We are not responsible for the availability, accuracy, or policies of third-party services. API keys you provide are encrypted and stored securely, and are only used to perform actions you explicitly request.
The Service uses artificial intelligence to assist with content creation. AI-generated content is provided as a suggestion and should be reviewed before publishing. We do not guarantee the accuracy, originality, or appropriateness of AI-generated content. You are solely responsible for all content published through your social media accounts.
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.
We aim for 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice when possible. Support is provided via email. Response times vary by plan tier.
You may delete your account at any time via Settings. Account deletion is subject to a 30-day grace period during which you can cancel the deletion and recover your data. After 30 days, all data is permanently and irreversibly deleted. We may suspend or terminate accounts that violate these Terms, with notice when reasonably possible.
To the maximum extent permitted by law, SunshineSlingshot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless SunshineSlingshot from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state in which the Company is headquartered.
